IMMIGRATION BY BUSINESS TALENT - VISA SUBCLASS 132B (BUSINESS TALENT VISA)

1. Program Overview

Visa 132 is an Australia immigration program as a Business Talent that is a permanent visa for business people who are nominated by an Australian state or territory government agency. With an investment of AUD 1,500,000, Visa 132 allows the applicant and their family to obtain directly permanent residency.

4. Conditions of participation

  • Nominated by a state/territory in Australia
  • Receive a visa invitation
  • Applicant must be under 55 years of age
  • No involvement in illegal business activities.
  • Applicants and all family members must meet health and criminal background conditions.
  • A clear desire to own and maintain a business management role in Australia
  • Sound a successful business history  
  • Applicant or spouse must meet all following conditions:
    • Equity in companies reaches a minimum of AUD 400,000 in the last 2 out of the last 4 financial years, immediately before receiving the invitation to apply for a visa, and if the business is publicly listed, the shareholding reaches at least 10%.
    • Total business assets and legal personal property of AUD 1.5 million and can be transferred to Australia within 2 years after being granted a visa.
  • The total annual turnover of businesses reaches at least AUD 3 million for at least 2 of the last 4 years, immediately before receiving the visa invitation.
  • Possess minimum:
    • 51% if turnover < 400.000 AUD/year.
    • 30% if turnover > 400.000 AUD/year.
    • 10% if the company is publicly listed.

5. Responsibilities of Applicant

  • If the applicant is not in Australia at the time the visa is granted, the applicant must enter Australia at the date specified by the Australian Department of Home Affairs.
  • The family members of the applicant are not allowed to get married or have a de facto relationship before they enter Australia (to be clearly instructed by the Australian Department of Home Affairs if this condition is applied).
  • Applicants and families must comply with all visa conditions as well as the laws of Australia
  • Applicants must comply with business conditions.
  • Must provide permanent residence address to Australian Department of Home Affairs within 6 months from the date of entry into Australia.
  • Applicants must notify if they have changed their place of residence (including within or outside Australia) by form 929 within 28 days before moving to their new residence.
  • After entering Australia, applicants need to:
    • Establish an eligible business in Australia, or
    • Join an existing business in Australia.
  • In that business, the applicants need to:
    • Maintaining substantial equity
    • Maintain direct and ongoing management
    • Make decisions related to the company's overall direction and performance in favor of the Australian economy.
  • After engaging in business activities in Australia, the applicant will be required to complete form 1010 - Business Qualification Survey.
